Law Day cases for Nov. 16
Judge Robert L. Koffman heard the following felony cases Nov. 16 in Pettis County Circuit Court, according to Prosecuting Attorney Jeff Mittelhauser:
•Gary Austin, 44, address unknown, pleaded guilty to two counts of tampering in the first degree, admitting that on Sept. 5 he unlawfully operated a truck owned by Gary Naylor and unlawfully possessed a motor scooter owned by Meloney Kohl. Both vehicles were recovered. Austin was sentenced to serve two years in prison.
•Dallas Carlock, 21, of Sedalia, entered a guilty plea to carrying a concealed weapon in connection with a Sept. 23, 2008 arrest by Sedalia Patrolman Aaron Berry. After a traffic stop, Berry found a handgun under the driver’s seat where Carlock had been sitting. He was sentenced to serve three years in prison.
•Timothy Cota, 17, of Sedalia, pleaded guilty to burglary in the second degree and resisting arrest. When Sedalia police officers responded to an alarm call at Game Zone Comics on Oct. 6, Cota ran from the business. Officers saw that the front window was broken and caught Cota a couple blocks away. Imposition of sentence was suspended and Cota was placed on probation for five years with requirements that he serve 45 days in jail as shock detention, pay restitution to the victim, and attend Victim Offender Mediation.
•Jerald Denny, 51, of Marshall, pleaded guilty to stealing after a May 29 arrest at Wal-Mart. Employees saw Denny make a purchase and then return to the store and attempt to steal the same merchandise he bought earlier. The offense was a felony because Denny has two prior stealing convictions within the past 10 years. He was sentenced to serve two years in prison.
•Demetrius Gray, 25, of Kansas City, pleaded guilty to assault in the second degree, admitting he recklessly caused serious injury to Nathaniel Harvey during a fight on June 13. Gray was sentenced to serve 180 days in jail.
•Joseph Harris, 18, of Jefferson City, pleaded guilty to damaging jail property. While an inmate in the Pettis County Jail in early September, Harris sharpened the handle of a toothbrush into a point. He was sentenced to serve 90 days in jail.
•Kimberly Klein, 52, of Cole Camp, was sentenced to serve three years in prison on a stealing charge. She entered a guilty plea in September, admitting she attempted to leave the Wal-Mart store with $500 worth of merchandise without paying for it.
•James C. Smith, 51, of Sedalia, pleaded guilty to two counts of assault of a law enforcement officer in the second degree. He was arrested April 23 when officers responded to a call in the 500 block of North Osage Avenue. As officers broke up a fight at that location, Smith approached Sedalia Patrolmen David Smith and Joshua Howell swinging a window frame with broken glass in a threatening manner. He was sentenced to serve 270 days in jail.
•Jacob Woolery, 22, Sedalia, pleaded guilty to driving while intoxicated. He was arrested by Sedalia Patrolman Travis Lorenz on May 23. The offense was a felony because Woolery has two prior convictions for DWI. Execution of a four-year sentence was suspended and Woolery was placed on probation for five years with requirements that he wear an alcohol detection bracelet, serve 40 days in jail as shock detention and perform 120 hours of community service work.
