A Cooper County jury has found a Sedalia man guilty of first-degree robbery in the theft of cash from the former Movie Gallery.
Johnny L. Allen, 50, was accused of threatening to use a gun when he robbed the Movie Gallery, 2921 W. Broadway Blvd., Dec. 24, 2006, said Prosecuting Attorney Jeff Mittelhauser. The jury deliberated for about an hour before returning its verdict Thursday in Cooper County Circuit Court.
Two store clerks, Adam Hayes and Stephanie Hopkins, testified that during the robbery Allen kept his hand in his pocket, but said he had a gun and threatened the two, said Mittelhauser. Allen stole $200 to $230, Mittelhauser said.
Allenís sentencing is scheduled for 10 a.m. Sept. 19 in Cooper County Circuit Court. Judge Hugh Harvey will sentence Allen without the juryís recommendation because he is classified as a persistent offender by virtue of two previous felony convictions.
Mittelhauser said the store, at 2921 W. Broadway Blvd., has since closed.
First-degree robbery is a class A felony, with a maximum punishment of 30 years or life in prison. Mittelhauser said Allen is being held in prison pending his sentencing.
Allenís public defender, Erin Heimsoth, said she plans to appeal the conviction.
