Aug. 18 Court Docket

Judge Robert L. Koffman heard these cases Aug. 18:


•Steven Bailey, 26, of Sedalia, was sentenced to 90 days in jail after pleading guilty two weeks ago to domestic assault in the third degree. The charge arose from a March 23 disturbance during which he injured Heather Simmons-McCoy by striking her.


•Christopher Bartlett, 32, of Sedalia, pleaded guilty to third-degree assault in connection with an April 2 assault. Bartlett struck John Washington in the head as Washington left Malone’s on Main. A 120-day jail sentence was suspended and Bartlett was placed on probation for 2 years, with conditions that he serve 10 days in jail as shock detention, pay restitution, and have no contact with the victim.


•Jimmie Joy Butler, 35, of Sedalia, pleaded guilty to the felony of passing bad checks, admitting she wrote checks on a closed account between July and October 2007. Imposition of the sentence was suspended and the defendant was placed on probation for five years with a requirement that she pay restitution to the merchants.


•Kevin Lee Doublin, 40, of Warsaw, pleaded guilty to stealing, admitting he stole a laptop computer and a cell phone from a Tyson Foods employee on March 29. He was sentenced to two years in prison.


•William Sindelar, 45, pleaded guilty to several felonies related to the distribution of marijuana. Pettis County Sheriff’s deputies served a search warrant at Sindelar’s home on Schenck Road Sept. 11 and found him and his wife, Carmen Sindelar, in possession of a large quantity. The two admitted they distributed the marijuana at the direction of another person. No charges were initially filed against the Sindelars because they cooperated with the investigation. Then, on May 13, deputies again went to the Sindelar home and found that they were cultivating several small marijuana plants. Charges were then filed on both the Sept. 11 and the May 13 events. The prosecuting attorney recommended a 15-year sentence with placement in the Institutional Treatment Program, and sentencing was set for Sept. 15. Carmen Sindelar is serving 15 years with possible probation if she successfully completes the Institutional Treatment Program. Vincente Carrasco, who was also charged in the investigation, served a 300-day county jail sentence after his guilty plea last month to possession of marijuana.


•In a proceeding under the Criminal Activity Forfeiture Act, the judge ordered the forfeiture of $2,029 seized from Jacob Nicholson during a June 13 investigation. Deputies arrested Nicholson after receiving information that he was delivering methamphetamine to an apartment on West 10th Street. Deputies found about 16 grams of meth and the cash. An additional, smaller quantity of the drug was located when he was searched at the jail. Nicholson pleaded guilty two weeks ago, receiving a nine-year prison sentence for possession with intent to deliver and a concurrent seven-year term for possession of a controlled substance in a jail. The forfeited funds will be deposited into the general school fund.


•On Tuesday Aug. 19, the court took up a contested sentencing hearing involving Anthony M. Staten, 40, of Sedalia. In June, Staten pleaded guilty, admitting that on Feb. 6, he stole a Sony Playstation 3 game deck and video games owned by Alvina Seabury. The offense was a felony because Staten had two prior misdemeanor stealing convictions. Staten also had three prior felony convictions. The prosecuting attorney sought a sentence of three years and opposed Staten’s request for probation. The court suspended execution of a four-year sentence and placed the defendant on probation for five years with a requirement that he pay restitution.
