A man arrested for allegedly exposing himself and urinating in plain view of dozens of guests Saturday evening near the Family Fun Center on the Missouri State Fairgrounds later apologized, telling officers he was drunk and “when you got to go, you got to go.”
Pettis County Prosecuting Attorneys charged Neil W. Lutjen, 42, of the 2800 block of Quail Run, on Monday with a single count of first-degree sexual misconduct, a class B misdemeanor, and set bond at $1,500 cash or surety.
According to a probable cause statement, at 10:24 p.m. a group of fairgoers flagged down Sedalia Police Department Detective Michael Elwood, who was working security at the event, and told him a man was urinating outside of the bathrooms directly south of the Family Fun Center and west of the Beef House.
When police arrived, they found Lutjen on his knees near the east end of the restrooms, with his genitals exposed, “obviously urinating” and not taking any precautions to prevent himself from being seen. A family with two small children and numerous other guests were walking by the area on the busy final Saturday of the fair, according to police.
After handcuffing Lutjen, police noticed obvious signs of intoxication. Approximately one hour after his arrest police said a Breathalyzer test resulted in a .174, more than double the .08 Missouri legal limit.
Lutjen volunteered a statement while at the county jail writing, “I am not a pervert. I was drunk. I had to (expletive). I (expletive) myself. I did not mean to offend anybody and I apologize. When you got to go, you got to go. My apologies, no offense to anybody. I am sorry.”
If convicted, a class B misdemeanor in Missouri carries a maximum penalty of six months incarceration. Lutjen could also be placed on the Missouri Sex Offender Registry.
